Terms and Conditions

By doing any business with Couture by Valquiria LLC, you agree to the following terms and conditions:

1. Due to the high costs in our business and the need to obtain custom materials, often on an expedited basis, we require the following payment schedule of our customers:

   a. An initial consultation fee as provided on our booking site,

   b. A deposit amounting to 50% of the price of the custom garment, including Maryland sales tax (if the custom garment is delivered within Maryland) within the time specified on the invoice,

   c. Final payment of the remaining 50% of the price (including applicable sales tax) of the custom garment at least 24 hours before you pick up your garment. 

2. Due to the personalized nature of our appointments, we have a non-refundable appointment charge. Unless canceled within 48 hours, the fee for our initial consultation is nonrefundable. An initial consultation is limited to one custom garment. If you plan to discuss more than one custom garment during the initial consultation, you must book an additional appointment(s). If you are more than 15 minutes late to your appointment, you agree to a 15-minute shorter initial consultation. If you are more than 30 minutes late to your appointment, your initial consultation is considered canceled, you agree to pay the initial consultation fee (i.e., it becomes nonrefundable), and you must book another initial consultation. If the initial consultation lasts longer than 60 minutes, we will charge you $25 for each 15-minute increment starting with the 76th minute. 

3. If you fail to make the payment described in section 1(b) above within the time prescribed in the invoice, your order is considered canceled, and Couture by Valquiria LLC disclaims any and all consequences stemming from such failure. If this paragraph applies to you, you must reschedule your appointment and pay our nonrefundable booking fee.

4. If your payment fails to clear or is returned by your financial institution, Couture by Valquiria LLC reserves the right to cancel your order and pursue legal remedies against you. If this occurs, you agree to liquidated damages of $2,000 for the recovery of your bounced payment in addition to the bounced payment itself.

5. You must book your appointment at least two months before your desired delivery date. If you do not book an appointment at least two months before your desired delivery date, we reserve the right to turn down your order, and your appointment fee is not refundable. Couture by Valquiria LLC may, in its sole discretion, offer expedited options that compensate us for quicker delivery. Such fees can significantly exceed the market. 

6. What we discuss during the consultation is final. You cannot make any changes to what we agree on. If you do not wish to proceed with the custom garment as discussed, you can schedule a new consultation.

7. If your appointment is held remotely, you are responsible for providing us with accurate information. We will make the custom garment according to the specifications you provide, and we disclaim any responsibility for inaccurate measures. 

8. If you cancel your order after making your deposit, you agree to liquidated damages in the amount of the deposit. In other words, the deposit is nonrefundable, and we will not finish your custom garment if you cancel your order after making the deposit.

9. We require a minimum of two fittings for in-person appointments. If you do not complete two fittings, you agree to accept the custom garment as is upon final delivery.

10. Any changes or modifications to the garment, price, delivery, or this agreement are at Couture by Valquiria's sole discretion. Couture by Valquiria may modify the delivery date at its sole discretion.

11. You have three days to pick up your custom garment. If you fail to pick up your custom garment within three days of notification, additional storage charges of $35/day will be charged. Any changes or modifications to the garment, its price, delivery, or this agreement are at Couture by Valquiria’s LLC's sole discretion.

12. If alterations are required upon final delivery of the custom garment due to a change in body size or shape, you agree to take full responsibility for the alteration costs. 

13. You will not hold any of our members or staff personally liable for any breach.

14. Before you take final delivery of your custom garment, you must identify any and all defects. Once you accept the custom garment, we are not liable for any defects or discrepancies subsequently discovered. In addition, Couture by Valquiria LLC disclaims any incidental, consequential, special, exemplary, or indirect damages, lost business profits, or lost data arising out of or in any way related to any breach committed.

15. After delivery, any request for additional alterations or modifications may result in an additional charge. You are responsible for those costs if you choose to go elsewhere for adjustment and alterations. We disclaim any and all responsibility for garments altered elsewhere.

16. Please note that under no circumstances will we design alterations to a product once it is completed. You must communicate any changes you wish to make before the work commences. If changes are considered and applied once production has commenced, these are at the designer's discretion and could incur additional charges to the client.

17. All designs are the intellectual property of Couture by Valquiria LLC, and individuals cannot copy, reproduce, modify, or adapt them in any way. Copyright belongs, at all times, to Couture by Valquiria, and the client is not permitted to recreate any elements of a design for any purpose(s).

18. You agree to share and, if applicable, tag us in all photos and social media posts that feature our products in a high-quality format so that we can promote our custom garments. Please let us know if you would like us not to show your face when we post you wearing our custom garments on social media. If you don’t tell us, then we will assume that you consent to us posting all images you provide us.
